Terms & Conditions

These Terms and Conditions (T&C) govern the contracting of tourist services (Tours, Travel Packages, Transfers, and Additional Services) offered by [Insert Legal Name of Company] (hereinafter, “The Agency”) to its clients (hereinafter, “The Client”). Contracting implies the full acceptance of these T&C.

1. RESERVATIONS, PAYMENTS, AND CONFIRMATION

1.1. Reservation Process
  • All reservation requests must be made through our official channels (website or email) and must be accompanied by the required personal information and the initial deposit.
  • The Agency will send a detailed quote with the description of the services, prices, and initial availability.
1.2. Initial Payment (Deposit)
  • To confirm the reservation, The Client must pay a non-refundable initial deposit equivalent to 30% of the total package cost.
  • Reservations made less than 30 days in advance require the payment of 100% of the total cost for immediate confirmation.
  • Non-Refundable Services by Supplier: Air tickets and special permits (e.g., Inca Trail, Huayna Picchu tickets) must be paid for at 100% at the time of booking and are not subject to subsequent refund or transfer.
1.3. Final Payment (Pending Balance)
  • The pending balance must be settled by The Client no later than 30 calendar days before the start date of the first contracted service.
  • Failure to settle the final payment will result in the automatic cancellation of the reservation by The Agency, and The Client will lose the initial deposit.
1.4. Personal Data
  • The Client is responsible for supplying their data accurately (full name, date of birth, nationality, and a legible copy of the valid passport or DNI).
  • The Agency is not responsible for problems or additional costs arising from incorrect data, especially in the issuance of tickets (train, air, Machu Picchu).

2. RATES AND DOCUMENTATION

  • Price Validity: Prices are subject to availability and variations imposed by third parties (Peruvian Government, Airlines, Railways). Once the total payment has been made, the reservation price is fixed and will not be adjusted.
  • Documentation: It is mandatory for The Client to carry the original passport or identity document used to make the reservation (minimum 6 months validity). Entry to archaeological sites such as Machu Picchu and train services are strictly nominative and linked to the registered document.

3. RESPONSIBILITY AND FORCE MAJEURE

  • Intermediation: The Agency acts as an intermediary between The Client and the final service providers (hotels, ground transport, local operators, etc.).
  • Force Majeure: The Agency is not responsible for non-compliance, delays, or alterations of the service caused by Force Majeure events, including, but not limited to: strikes, road blockades (paros), natural disasters, social conflicts, airport closures, extreme weather conditions, or governmental provisions.
  • Procedure in Case of Force Majeure: In these cases, The Agency commits to:
    • Making every possible effort to reschedule or modify the itinerary seeking to minimize the impact on the trip.
    • Assisting The Client in managing refunds for unused services, applying the suppliers’ penalties.
    • Additional costs for transportation, accommodation, or ticket reissuance generated by Force Majeure events will be assumed by The Client.

4. HEALTH AND PHYSICAL REQUIREMENTS

  • The Client must inform The Agency about any medical condition, allergy, or physical limitation.
  • For High-Demand Tours (e.g., Rainbow Mountain, Humantay Lake, Ausangate or Choquequirao Treks), The Client confirms that they possess the necessary physical condition and assume the risks inherent to high-altitude activities and the Andean climate.
